How Do I File an Intent to Cure? << Back

Notice of Intent to Cure must be filed with the office of the Public Trustee at least 15 days prior to the foreclosure sale date. Recorded documents evidencing the right to cure must accompany the notice. For example, the property owner must provide recorded evidence of ownership, such as a recorded deed. Copies of recorded documents may be purchased at the Clerk and Recorder’s office located at 1402 N. 17th Avenue, Greeley, Colorado.

Upon receipt of the completed notice of intent to cure form and proper support documentation, the Public Trustee will request the cure amount from the attorney for the foreclosing party. The foreclosing party must provide the cure amount to the office of the Public Trustee on or before noon on the seventh calendar day prior to the sale date. Failure to provide these figures when due will postpone the foreclosure sale for at least two weeks.

If you have filed a Notice of intent to cure, it is your responsibility to contact the office of the Public Trustee office to obtain the cure figures. Cure funds must be paid to the office of the Public Trustee no later than noon the day before the foreclosure sale.

Some Things to Remember


  • The Public Trustee cannot accept late notice of intent to cure forms.
  • It is suggested that you file your notice of intent to cure as early as possible.
  • It is your responsibility to contact the office of the Public Trustee for updated.
    cure figures, as interest, late fees, attorney fees, etc., continue to accrue.
  • Please provide a phone number and either a fax number or email address where we may contact you.
